Competition Terms and Conditions

Conditions of Entry

• Information on how to enter and about prizes form part of these conditions of entry. Participation in this competition constitutes acceptance of these conditions of entry.
• Entry is open to all permanent residents of Australia except directors, management and employees of the Promoter or of the agencies or companies associated with the competition and the immediate families of these persons (Eligible Entrants).
• Competition commences on 10/01/07 and closes at 23:59pm on 25/04/07 (Promotional Period).
• To enter, Eligible Entrants must, during the Promotional Period, visit http://www.sharkcamo.com.au/ and complete the online entry form, including their name, age, State/Territory, email address and describe in 25 words or less: "why you use (or plan to use) Shark Camo". Online entry forms must be submitted online and received by the Promoter during the Promotional Period.
• Multiple entries are permitted provided that each entry is submitted separately via the online entry form and provides a unique "25 words or less" description.
• All entries become the property of the Promoter. Each "25 words or less" statement must be the entrant's original work. By entering this competition entrants:
  1. consent to the Promoter making and publishing copies of the whole or part of their entry (including the "25 words or less" statement) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and
  2. undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
• This is a game of skill. Chance plays no part in determining the winner. Each valid entry received during the Promotional Period will be individually judged by representatives of the Promoter based on, among other things, creative merit. Winners will be notified by email and published on http://www.sharkcamo.com.au/. The Judges' decisions are final and no correspondence will be entered into.
• The most creative valid entry, as determined by the judges, will win a 'Surf Gear Prize Package' (Major Prize). The Major Prize consists of $400 worth of surf gear including an FCS Board Bag, Shark Camo, an Underwater Camera and wax.
• Total prize pool is valued at up to $400.00 (inc GST). The value of the prizes is accurate as at the commencement of the Promotional Period and the Promoter will not be responsible for any variation in the value of the prizes after that date.
• The winners will be notified by email and their name and state/territory of residence will be posted on the Shark Camo website at http://www.sharkcamo.com.au/. Prizes are not transferable or exchangeable and cannot be taken as cash. Where any prizes are unavailable for any reason, the Promoter reserves the right to substitute for that prize another item of equal or greater value as determined by the Promoter.
• The Promoter may require entrants to show that they are an Eligible Entrant. Validation may (in the Promoter's sole discretion) include the entrant providing the Promoter with:
  1. proof of permanent residence status; and
  2. proof of identity and age (identification considered suitable for verification is at the discretion of the Promoter).
• The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence arising from any error, omission, alteration, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communication networks or lines and accepts no responsibility for any problems associated with them, whether due to network traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any costs incurred, responses received or any other consequences of user error. Any costs associated with accessing the Shark Camo website is the Eligible Entrant's responsibility and is dependent on the Internet service provider used.
• The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web sites, or any combination thereof, including injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in the competition.
• Prizes must be claimed by 25/05/07. If the Major Prize remains unclaimed by that date or the winner cannot take the prize, that winner's entry will be deemed invalid and the Promoter reserves the right to distribute that prize to the 2nd most creative valid entry.
• The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this competition, or using any prize except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
• The Promoter reserves the right, in its sole discretion, to disqualify all entries from any person, and prohibit that person's further participation in this competition, who tampers with, or benefits from any tampering with, the entry process or the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any person.
• The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
